GARNER — One pedestrian is dead after an accident in Garner.

The incident happened Sunday night shortly before 10 p.m. on U.S. Highway 70 West between the Interstate 40-70 interchange and the Greenfield Parkway exit. According to the State Highway Patrol, Ederett Hurley Jr. of Angier was walking in the road when he was struck by an SUV going 50 mph to 55 mph.

The State Highway Patrol said the driver of the SUV will not be charged.
